Luna Park in Sydney, Australia, has won a court battle against local residents who wanted noisy rides shut down and moved to another part of the site.
Residents of Lavender Bay claimed the noise from the rides and the screaming of riders had been unbearable since the park reopened in 2004.
Although the battle began as a noise case, it became a trade practice issue when the residents claimed they were led to believe that the rides would not be located in the northern extension of the park.
The Supreme Court ruled however that Luna Park's development application had not been misleading or deceptive.
